Terms and Conditions of the Contract
The owner of the website www.mir2026frenchriviera.com is Club Maserati France, located at 38 rue Dailly, 92210 Saint-Cloud - France, an association governed by the French law of 1901, registered with the Hauts-de-Seine prefecture under number W922003724 (hereinafter, "Maserati Owners Club France"). These "General Terms and Conditions of Contract" constitute a legally binding agreement between you and Maserati Owners Club France governing access to and use of the website indicated in the header of this document.
Article 1 – Glossary
The following definitions apply to these general terms and conditions:
- Site: the website www.mir2026frenchriviera.com, owned by Maserati Owners Club France, through which applicants are informed of the characteristics of the Maserati International Rally 2026 event, the registration procedure, and where the applicant is offered the registration form.
- Applicant(s): Any natural or legal person applying to participate in the Event who correctly uses or connects to the Site to complete a Pre-registration, and may subsequently be confirmed for Registration and a Reservation.
- Applicant Data: The information provided by Applicants on the Site, as well as information relating to payments made.
- Event: the Maserati International Rally 2026 French Riviera (hereinafter, the "MIR").
- Pre-registered: Any Applicant who has exhaustively completed a Form on the Site and received a notification from the Site and/or an email from the Organizer confirming this status is deemed "Pre-registered".
- Registered: Any Applicant who has exhaustively completed a Form on the Site and received a notification from the Site and/or an email from the Organizer confirming this status is deemed "Registered".
- Waiting List: Any Applicant who has exhaustively completed a Form on the Site and received a notification from the Site and/or an email from the Organizer confirming this status is deemed to be on the "Waiting List".
- Reservation: Any Applicant who has been notified by the site and/or who has received an email from the Organizer granting them "Registered" status, and who has made their down payment by bank transfer within the specified deadlines, holds a Reservation.
- Form: the document to be completed offered by the Site in which the Applicant provides, among other things, personal information (surname, first name, name of their Maserati Club, email address and telephone number, etc.) and a copy of the Vehicle Registration Certificate.
- Payment(s): The deposit or balance made by the Applicant in the form of a bank transfer, in payment for the Event to the benefit of the Organizer's Account.
- Participant(s): The Applicant who, in compliance with the General Terms and Conditions of Sale of the Site, has had their Reservation confirmed by the Organizer.
- Organizer: Maserati Owners Club France
- Service Provider(s): Any supplier of goods and services selected by the Organizer for the organization of the Event.
- Maserati Presidents Club: The club of Presidents of Maserati Clubs officially recognized by Maserati S.p.A.
- Concours d’Etat: A competition based on an independent jury to establish rankings of the most beautiful vehicles participating in the Event in predefined categories.
- Challenge Gentleman Driver: A regularity event on open roads organized by the company Rallye Viallard Sport exclusively for the Organizer.
- These Regulations and Other Rules: These General Terms and Conditions of Contract, as well as other rules and guidelines determined by Maserati Owners Club France, including the Privacy Policy and Cookie Policy of the Site, managed by Maserati Owners Club France.
Article 2 – Purpose
- These Contractual Conditions establish the terms under which access to the Maserati Owners Club France Site is offered to Applicants. By accessing the Site, you fully and unreservedly accept these Contractual Conditions. If you do not agree with, do not understand, or do not feel comfortable with any of the clauses set out in these Contractual Conditions, you must refrain from using the Site, even for purely informational purposes. Mere access to and browsing of the Site are subject to the Contractual Conditions of Maserati Owners Club France.
- By accepting these contractual conditions, you declare:
- That you have read and understood what is stated in this document.
- That you assume all the obligations set out in this document.
- That you are of legal age and have sufficient legal capacity to use the site and operate with it.
- Access to this Site does not imply, under any circumstances, the commencement of a commercial relationship with Maserati Owners Club France.
- To register for the Event organized by Maserati Owners Club France, it is necessary to first complete a pre-registration by filling out a form on the Site. You acknowledge and agree that Maserati Owners Club France may, at any time, add and/or modify functionalities of the Site and/or the selection conditions for Applicants in accordance with the guidelines given by the Maserati Presidents Club.
Article 3 – Parties Involved
Natural persons who are of legal age (over 18 years old) and who accept these General Terms and Conditions of Contract will, where applicable, be considered "Applicants" of the Site www.mir2026frenchrivviera.com.
The contractual process between the Applicant and Maserati Owners Club France is carried out electronically, through the Site www.mir2026frenchriviera.com and/or emails, it being understood that the first payment commits both parties from a contractual point of view.
Article 4 – Selection of Participants and Payment Method
- The Site can be consulted from August 1, 2025, to learn about the program and the conditions of participation in the Event.
- The Applicant must be a member of one of the Maserati Clubs recognized by Maserati S.p.A. as listed in the pre-registration form and on the website https://www.maserati.com/fr/fr/ownership/maserati-club and be up to date with their membership fees on the first day of their participation. The Organizer reserves the right to carry out checks with the declared member clubs.
- Pre-registration is essential to hope to participate in the Event. It is possible on the Site from September 17, 2025, to November 30, 2025, and requires completing the online Form and providing the requested attachments.
- In addition to the priority conferred by the date of pre-registration, the Organizer has programmed the Site according to priority criteria aligned with the directives given by the Maserati Presidents Club in order to favor:
- the seniority and diversity of models
- sportiness
- the geographical diversity of participants
- Provided that the pre-registration process is completed by the Applicant, they will be notified of their status by the Site: "Registered" or "Pre-registered". In the event that either the quota allocated to the original Club is reached, or the maximum number of participants is exceeded, the Applicant is invited to join the "Waiting List", it being understood that they can refuse.
- Registration, whether immediately notified by the Site or confirmed after Pre-registration by the Organizer, will be confirmed by email sent to the Applicant before December 15, 2025, accompanied by a request for a 50% deposit to be paid before December 31, 2025.
- All payments must be made exclusively by Bank Transfer to the account of "Club Maserati France MIR 2026" of the Crédit Agricole de St. Galmier Agency. IBAN xxxxx BIC XXXX.
- The date of receipt of the deposit Payment by the Applicant transforms the registration into a Reservation. The balance must be paid before March 1, 2026.
- The transformation of the registration into a Reservation changes the Applicant's status to Participant.
- Any Applicant submitting an online application accompanied by a payment before confirmation of Registration by the Site and/or the Organizer, will have their application canceled and will receive a refund by bank transfer of the amount paid, less any bank charges, within fifteen (15) working days from the date on which they provided their own bank details.
- For the sake of clarity, the price of the Reservation includes 3 nights, including breakfasts at the Hôtel Martinez in Cannes, lunches, cocktails, dinners, and generally all services as described in the detailed program of the MIR provided by the Organizer. All other requests for services or benefits not mentioned in the program with the Organizer's suppliers, or other suppliers, remain the exclusive responsibility of the Participant. The same applies to travel and return costs, as well as direct and indirect costs related to motorized travel undertaken individually before, during, and after the Event.
- Registration for the event through an agent or a third party is not permitted.
- The Participant declares that all information provided to Maserati Owners Club France is true, complete, accurate, exhaustive, and up to date; otherwise, Maserati Owners Club France may, after informing the Participant, suspend their participation in the Event.
- The Participant must notify Maserati Owners Club France, by email to jean-françois.brin@clubmaseratifrance.com, of any updates and/or modifications to the information provided during pre-registration, in particular any change of vehicle, as it may call into question the reservation granted to the Participant and their status as Participant.
Article 5 – Cancellation and Refund Policy
- In the event that a Participant must cancel their participation in the MIR, they must imperatively notify the Organizer by email to jean-françois.brin@clubmaseratifrance.com, indicating the reasons and supporting documents for their cancellation from the Event. The cancellation notice will only be effective if it is complete and received by email.
- Any cancellation of the Reservation for the Event notified in accordance with section 5.1 by the Participant to the Organizer before March 21, 2026 (D-180), will result in a refund by bank transfer of the full amount paid, less any bank charges, within fifteen (15) working days from the date on which the Participant provided their own bank details.
- Provided that the reasons for cancellation of participation fall within the cases of force majeure referred to in Article 7, or are justified by a medical certificate from the Participant, or due to the justified unavailability of the registered vehicle, any cancellation of the Reservation for the Event notified in accordance with section 5.1 by the Participant to the Organizer before June 20, 2026 (D-90) will result in a refund by bank transfer of 50% of the total amount paid, less any bank charges, within fifteen (15) working days from the date on which the Participant provided their own bank details.
- Provided that the reasons for cancellation of participation fall within the cases of force majeure referred to in Article 7, or are justified by a medical certificate from the Participant, or due to the justified unavailability of the registered vehicle, any cancellation of the Reservation for the Event notified in accordance with section 5.1 by the Participant to the Organizer before August 3, 2026 (D-45) will result in a refund by bank transfer of 30% of the total amount paid, less any bank charges, within fifteen (15) working days from the date on which the Participant provided their own bank details.
- Any cancellation of participation in the Event made by the Participant after March 21, 2026 (D-180) whose conditions do not fall within the framework described in sections 5.3 or 5.4, or whose notification does not comply with section 5.1, will not give rise to any refund by the Organizer.
Article 6 – Fraudulent Payments and Transactions
- All transfers made by Participants will be cashed by Maserati Owners Club France into an account dedicated exclusively to the management of the Event.
- Maserati Owners Club France declares that it is not able to establish the origin of the funds transferred to its bank account by the Participants.
- In the event that Maserati Owners Club France is the victim of attempted fraudulent Payments by a Participant, it reserves the right to file a complaint and communicate all the information it has to the competent authorities.
- Due to payment by bank transfer, Maserati Owners Club France does not have access to the bank details of the Participants but is authorized to request them in the event of a refund and undertakes not to keep them beyond the time necessary to allow the accounting closure of the Event.
Article 7 – Force Majeure
- In accordance with these General Terms and Conditions of Contract, "force majeure" means any event that the Organizer cannot foresee, including but not limited to threats, fires, terrorist activities, industrial disputes, natural or nuclear disasters, epidemics, wars or riots, and any other event beyond the control of the Organizer.
- The Organizer will not assume any liability or expense, and Participants will not be entitled to any damages or compensation, in cases where the Event cannot take place or in cases where the Organizer cannot meet punctually or must fail to meet its obligations in accordance with the Contractual conditions that have been agreed between the Parties for participation in the Event.
- The Organizer reserves the right to make any changes to the program, provided that the reasons justifying them fall within the framework described in section 7.1.
Article 8 – Regulations of the Concours d’Etat
- Participation in the Concours d’Etat is optional and does not entail any modification of the amount of the Contribution; it must be declared by the Candidate during Pre-registration.
- The Participant in the Concours d’Etat undertakes not to contest either the rules, as defined by the Organizer and presented in the program given to participants, or the results as defined by the jury appointed by the Organizer.
- The Organizer reserves the right to modify the regulations of the Concours d’Etat at any time without having to justify the reasons, and undertakes to inform the Participants in advance.
Article 9 – Regulations of the Challenge Gentleman Driver
- Participation in the Challenge Gentleman Driver is optional and does not entail any modification of the amount of the Contribution; it must be declared by the Candidate during Pre-registration.
- The organization and all mandatory administrative procedures for the Challenge Gentleman Driver are entrusted by the Organizer to the company Rallye Vialar Sport, 390 Chemin la Blache, registered with the Aubenas Trade and Companies Register under number 852 799 469 00014 (hereinafter "RVS").
- The Challenge Gentleman Driver is a declared and authorized event by the Prefecture of Alpes de Haute Provence, the purpose of which is to reward Participants capable of driving at a slow and steady pace of less than 50 km/h on a secondary road segment of about ten kilometers in strict compliance with the Highway Code.
- The Participant in the Challenge Gentleman Driver must ensure that their insurance policy allows them to participate in a regularity event on open roads, with an average speed specified in the event regulations, necessarily less than 50 km/h and in accordance with regulations, on a road segment of about ten kilometers, including electronic timekeeping.
- The Participant in the Challenge Gentleman Driver undertakes not to contest either the rules, as defined by the Organizer and its service provider RVS and presented in the Event program, or the results.
- The Organizer reserves the right to modify the regulations of the Challenge Gentleman Driver at any time without having to justify the reasons, and undertakes to inform the Participants prior to the holding of the Challenge Gentleman Driver.
- The Organizer and its service provider RVS decline all responsibility in the event of a car accident occurring within the framework of the Challenge Gentleman Driver and generally throughout the Event.
- Participation in the Challenge Gentleman Driver is imperatively subject to the participant returning the duly completed and signed liability waiver, which is sent to you by email upon confirmation of your Registration.
Article 10 – Content and Links
- Maserati Owners Club France has obtained the information, multimedia content, and materials included on the Site from sources it deems reliable but, while having taken all reasonable steps to ensure that the information contained is correct, Maserati Owners Club France cannot guarantee its accuracy on the date of consultation of the Site. Maserati Owners Club France expressly disclaims any liability for errors or omissions in the information contained on the Site.
- Maserati Owners Club France reserves the right to modify, suspend, cancel, or restrict the content of the Site, the links, or the information obtained through the Site, without prior notice.
- Maserati Owners Club France is not responsible for any damages that may result from the use of the information available on the Site or that contained in the social networks of Maserati Owners Club France.
- Maserati Owners Club France may provide access to third-party sites through links intended to inform about the existence of other sources of information on the Internet. These links to other sites do not in any way constitute a suggestion or recommendation to visit the destination web pages and are beyond the control of Maserati Owners Club France, so Maserati Owners Club France is not responsible for the content of the links, the linked websites, or the result obtained by following the links. Similarly, Maserati Owners Club France is not responsible for the links present on the sites to which Maserati Owners Club France provides access.
- The establishment of the link does not imply, under any circumstances, the existence of relations between Maserati Owners Club France and the owner of the site on which the link is established, nor the acceptance or approval by Maserati Owners Club France of its content or services. If you access an external website from a link found on the Site, you should read the privacy policy specific to the other website, which may differ from that of this Site.
- The Site offers sponsored content, advertisements, and/or affiliate links.
- The information that appears in these affiliate links or in the inserted advertisements is provided by the advertisers themselves, so Maserati Owners Club France is not responsible for any inaccuracies or errors that the advertisements may contain, and does not guarantee in any way the experience, integrity, or responsibility of the advertisers or the quality of their products and/or services.
Article 11 – Disclaimer of Liability
- You acknowledge and agree that Maserati Owners Club France is not responsible for damages caused by system interruption, delay, suspension, or data loss due to connection or equipment failure, unauthorized access to data, or other damages incurred by you in connection with your use of the Site. Without prejudice to the foregoing, Maserati Owners Club France will make its best efforts to protect the interests of Maserati Owners Club France against damages caused by system interruption.
- Maserati Owners Club France is not responsible for any loss or damage caused by the Applicant's or Participant's breach of these General Terms and Conditions of Contract.
- To use the Site, you will need a compatible device, an Internet connection, and one of the payment methods accepted by Maserati Owners Club France, and it cannot be held responsible for difficulties encountered by Applicants or Participants in accessing the Site.
- Maserati Owners Club France may suspend the use of the Site, in whole or in part, or take necessary measures, without prior notification to Applicants or Participants, in order to maintain the quality of service.
Article 12 – Validity / Severability
The nullity or unenforceability of any of the stipulations of these General Terms and Conditions shall not affect the remainder of these General Terms and Conditions nor their validity or enforceability or any of their stipulations. The Parties shall do their utmost to replace any null or unenforceable stipulation with a valid stipulation having the same effect and reflecting their original intention.
Article 13 – Updating these Contractual Conditions
- Maserati Owners Club France may periodically revise these General Terms and Conditions. The modifications or additions introduced by Maserati Owners Club France will take effect immediately upon their publication on the Site.
- You acknowledge and agree to be bound at all times by these Contractual Conditions applicable to the Site and you undertake, consequently, to execute and comply with them.
- In the event that Maserati Owners Club France entrusts a trusted third party with the custody of successive versions of these General Terms and Conditions of Contract, the Parties acknowledge as the sole valid version at any time that which appears in the database of the trusted third party of Maserati Owners Club France.
Article 14 – Applicable Law and Jurisdiction of the Courts
- These General Terms and Conditions and any dispute arising from or relating to their conclusion and/or their interpretation and/or their execution and/or their termination are governed by and construed in accordance with French law, without regard to its conflict of laws rules.
- The Parties agree to use their best efforts to amicably settle any potential dispute relating to the conclusion and/or the interpretation and/or the execution and/or the termination of these General Terms and Conditions. Failing amicable settlement within a reasonable time, the Parties, expressly waiving any other jurisdiction, agree that only the courts within the jurisdiction of the Court of Appeal of Versailles shall have jurisdiction to hear any dispute relating to the conclusion and/or the interpretation and/or the execution and/or the termination of these General Terms and Conditions.
